Brazil’s national data protection agency (ANPD) has imposed an immediate halt on Meta’s policy that permits the use of Instagram and Facebook posts to train generative AI models. This decision follows weeks after Meta withdrew similar plans in the UK and Europe. The ANPD cited the risk of serious and irreparable damage to users’ fundamental rights as the reason for this suspension. Meta, which boasts 102 million Facebook users and 113 million Instagram users in Brazil, has been given five working days to amend its privacy policy or face daily fines. The company’s updated policy, which was also under scrutiny in Europe, would have used user-generated content to enhance AI products. Critics, including Pedro Martins from Data Privacy Brasil, argue that Meta’s data protection measures are inconsistent between Brazilian and European users, noting that posts from minors in Brazil were at risk of being used for AI training. Meta has yet to address these specific concerns publicly.
